Visions Golf makes motion to dismiss new lawsuit

Visions Golf, LLC., the company that owns the Hills and the Lakes golf courses in the Walden Lake community, has made a motion to dismiss a new lawsuit filed by the Walden Lake Community Association. The motion for dismissal was filed on Thursday, Sept. 17.

The plaintiffs for the new lawsuit are the WLCA, Bruce Garceau and George and Joanna Clifford. In the initial complaint, the plaintiffs sought declaratory judgment, temporary injunction, permanent injunction and class action certification.

Visions Golf filed for dismissal due to the plaintiffs’ failure to state a cause of action. Additionally, in the motion to dismiss complaint, Visions Golf also states that the plaintiffs fail to identify restrictive covenants.

The reasons outlined in the motion to dismiss are similar to the ones made earlier this summer, when the Walden Lake Community Preservation Inc. was a primary plaintiff. Although the WLCP is not involved in the new lawsuit, Visions still claims that the remaining plaintiffs lack standing.
